Important guidelines and terms for selling on AcrossMart platform.
Dear seller, you will be able to create a store which may be subject to review for approval or disapproval. You consent to be responsible for your offerings, products and transactions. You attest to have a legal title to the products and rights in your posts and/or store.
You should not post product and/or information of solely promotional nature with no actual offers of the products. You have the necessary license and/or are authorized by applicable law to advertise, offer for sale, and distribute the products you post.
Unless you own or control the relevant rights in content, you must not sell, lease, redistribute, sub-license, exploit and/or republish any content from our platform. However, you have the explicit right to send, forward, redistribute our adverts and/or promotional contents.
At any point in time should we require it for due diligence, it is binding on you to oblige and provide to us any relevant information, access to your business premises, and/or document that we may supply to relevant authorities in order to identify you and/or facilitate our compliance with our legal obligations relating to payments made to us and/or processed by us and/or any other relevant dealing.
Any content and/or information you submit to us or post remain your intellectual property and we will not claim ownership of the copyright and/or any other intellectual property rights in such. However, you hereby waive all moral rights in such content to the maximum extent permitted by applicable law and that you warrant and represent that you agree we may retain and use such for our enhancement purposes to build better services.
Any content you post means you have willingly and irrevocably grant AcrossMart continuous, royalty-free and nonexclusive right to use such content anywhere, anyhow and/or anytime with or without prior notice.
You also undertake to have the full and exclusive right to all contents that you bring forth in offers, posting, submission and/or otherwise and as such you indemnify AcrossMart of all liabilities and claims that could result from its use of such content.
In our sole discretion, any breach or negative review about you could result in last-strike-warning, suspension and/or permanent denial of your access which may lead to penalty and/or legal action.
Business owners or their staff are responsible for offering their products by sending available and in-shop products actual and unaltered pictures. This should include information regarding price, details and specifications and/or the likes of.
We may at our discretion, delay, modify and/or delete offered product(s) subject to our review so as to ensure and maintain quality control & assurance measures. Your offerings must be factual and you must cancel offers that are no longer available.
The only products allowed to be listed on our platform are products that do not fall within the category of products prohibited or fall short of our guidelines, regulations, policies, terms and conditions and any other relevant rules and regulations and/or any applicable law.
To that end but not limited to, you must not post any offer for sale or exchange any:
Also, you should not post anything that infringe or violate the rights or interests of others, including any intellectual property rights, any other proprietary and/or personal rights of any third party.
When offering products, ensure to take into account tax and all other applicable charges; equally important, ensure to abide and oblige with all its provisions. Whenever you receive a buyer purchase request on your product(s), ensure to double-check products condition and expiration then snap it legibly and send offer to the buyer.
The product(s) must be of satisfactory quality for its specified purpose, and must conform in all respect to the product offer and any other description supplied or made available by you to the buyer at the time of his/her request.
We reserve the right to check and either accept or reject the product(s) in line with our quality control & assurance measures. AcrossMart reserves the right to modify, edit, takedown, delete or remove any offer/business at all times.
In its sole discretion, AcrossMart also reserves the right to terminate your rights to its services use; edit, remove and/or cancel contents or offers or even terminate your account.
Our services are generally free. During on-boarding, sellers will be required to provide dedicated bank account details. When a buyer purchases your product(s), AcrossMart withhold the money and issue the buyer the Acceptance Code and your business information.
When the buyer directly or by proxy (such as family, friend or delivery partner) reaches you and inspects the product and is satisfied with it, then the Acceptance Code will be issued to you and the purchase money will automatically be transferred to your dedicated account details while you issue the product(s). This finalizes the transaction.
Note that a 2.5% platform commission will be deducted of the purchase money before remittance to you. We can only drive commission when we make you a sale.
Seller consents that commissions will be calculated as a percentage of the selling price, VAT inclusive and/or any other relevant applicable charges the buyer paid. All charges are exclusive of conventional applicable fees such as bank charges. All charges are non-negotiable and non-refundable unless otherwise explicitly provided by mandatory rules of applicable laws.
Evidence of payment to your dedicated account constitutes final and conclusive evidence of payment and receipt. If for any reason you dispute a transaction, such shall be brought to our notice within one (1) week of the date of the relevant transaction, failure to do so waive any such claim.
We shall not be held liable for any loss and/or damage to you that may result from fraud and/or error in respect of your account.
After a transaction is completed, there is a 48hrs window for the buyer to dispute the transaction should there be the need. Thereafter he/she consents to acknowledgement of the good(s) "as is", "as available", and "with all fault if any" and has hence waived the rights for return, replace and/or refund.
This is not applicable to all categories as there are products that are exempt from dispute hence cannot be returned, replaced and/or refunded. Examples include but not limited to Underwear, Cereal, Personal Care products etc. Such products are duly flagged when placing order.
You can use our payable services e.g., advertisement to promote your products and attract more direct sells. We offer convenient packages and the fees for using payable services are disclosed on the platform.
If you opt for advert service, the post will be projected overall and especially to its targeted buyers with your added offer such as Promo, Discount, New Order etc. Advertisement services are not subscription-based and therefore have to be renewed manually at will.
All our guidelines, regulations, policies, terms and conditions shall be governed by and in accordance with the laws and provisions of the Federal Republic of Nigeria. By using our services as a seller, you at all times hereby voluntarily, unreservedly, irrevocably, willfully, knowingly and unconditionally consent to have read, understood and agreed to all our guidelines, regulations, policies, terms and conditions wholly.
With registered RC No.1946934 and head office located at 65 Rijiyar Zaki Qtrs, Kano, Kano State, Nigeria; any resolution or dispute either or not from using our services shall be deliberated to exclusive jurisdiction of Kano State, Nigeria.
AcrossMart reserves the rights to updates, modifications and/or changes to its services, guidelines, regulations, policies, terms and conditions anywhere, anyhow and/or anytime with or without prior notice. If for any reason any of these conditions shall be adjudged null, it shall be adjudged severable and shall to the extent of its severability not affect the validity and enforceability of any other condition.
