Terms for logistics companies that deliver for AcrossMart buyers and sellers. They apply together with our Terms & Conditions.
Last Updated: 15 October 2026
These Delivery Partner Terms (the "Partner Terms") govern the relationship between AcrossMart Nigeria Limited (RC No. 1946934) ("AcrossMart", "we", "us" or "our") and any company or business that applies to be, or is approved as, a delivery partner on the AcrossMart Platform (the "Partner", "you" or "your").
The Partner is an independent contractor. Nothing in these Partner Terms creates an employment, agency, partnership or joint venture between the Partner and AcrossMart, and the Partner has no authority to bind AcrossMart or to make representations on its behalf.
The Partner Terms apply in addition to our Terms & Conditions and Privacy Policy, which the Partner accepts in full. Where the Partner Terms and the general terms differ on a matter specific to delivery partners, the Partner Terms prevail.
To become a delivery partner, you submit the partnership application on the Platform with accurate, complete and up-to-date information about your company, including its certificate of incorporation, the identification of a director or owner, your tax certificate and NIPOST licence where applicable, the vehicle types you operate, the states you serve and the bank account to which any payments to you are made.
Applications are reviewed by AcrossMart, and approval, disapproval, suspension or removal of a Partner is at AcrossMart's sole discretion. We may request further information, documents or access to your business premises for due diligence at any time, and you undertake to provide them.
You warrant that your company is lawfully registered, that it holds all licences and permits required to provide delivery services in the states you serve, and that it complies with all applicable tax, regulatory and industry obligations. You will keep the information in your application current and notify us promptly of any material change.
On the AcrossMart Platform, a buyer pays for a product and then inspects it, directly or through a proxy, before releasing the Order Acceptance Code to the seller. Where a buyer engages you as their proxy, you act strictly on the buyer's instructions and in the buyer's interest.
Delivery fees are agreed between the Partner and the buyer or seller who engages the Partner, unless an AcrossMart programme states otherwise on the Platform. AcrossMart is not a party to that arrangement and is not liable for its payment or performance.
Any payment that AcrossMart makes to the Partner under a programme is made to the bank account registered in the Partner's application, after any applicable charges and taxes. Evidence of payment to that account constitutes final and conclusive evidence of payment and receipt. Any dispute about a payment must be brought to our notice within one (1) week of the relevant transaction; failure to do so waives the claim.
In the course of a delivery you may receive the names, contact details, addresses and order information of buyers and sellers. You use that information solely to perform the delivery concerned, you protect it against unauthorised access, and you do not retain it beyond what the delivery requires or use it for marketing or any other purpose.
Information about AcrossMart's operations, systems and commercial arrangements that is not public is confidential and must not be disclosed to third parties. Your own data is handled in accordance with our Privacy Policy.
You are responsible for any loss of, or damage to, a product while it is in your custody, and for the acts and omissions of your riders, staff and sub-contractors. You indemnify AcrossMart and undertake to keep it indemnified against all claims, damages, costs, losses, liabilities and expenses, including legal expenses, arising from your delivery services or from any breach of these Partner Terms.
AcrossMart provides the Platform "as is" and "as available", makes no warranty as to the volume of deliveries a Partner will receive, and, to the full extent permitted by law, is not liable for any indirect, incidental or consequential loss, including loss of profit or business interruption, arising from the Partner's participation on the Platform. The disclaimers and limitations in our Terms & Conditions apply to the Partner.
AcrossMart may suspend or terminate a Partner's access to the Platform at any time, with or without notice, including where the Partner breaches these Partner Terms, receives substantiated complaints from buyers or sellers, or provides false or misleading information. The Partner may withdraw from the Platform at any time by notifying us, subject to completing any delivery already in progress.
Obligations relating to confidentiality, data, liability and indemnity survive suspension or termination.
These Partner Terms are governed by the laws of the Federal Republic of Nigeria. Any resolution or dispute, whether or not arising from the use of our services, is subject to the exclusive jurisdiction of Kano State, Nigeria. AcrossMart may update these Partner Terms at any time, and continued participation on the Platform after an update constitutes acceptance of the most current version. If any provision is adjudged null, it is severable and does not affect the validity of the remaining provisions.
The partnership application is completed by a named signatory on behalf of the company. By submitting it, the signatory confirms that they are authorised to enter into contracts for the company, and the company agrees to be bound by these Partner Terms from the date of submission. AcrossMart records the signatory's name, designation and the time of acceptance with the application.
